UPON CERTAIN ~S L00ATED ~EIN S~ID CITY: SETTING O~ ACTUAL COSTS INC~RED BY SAID CITY T0 ACCOMPLISH SUCH A~TEE~ A~ ~ING EE COST 0F SUCH A~TEE~ 0F SA~ NUISANCe, AND DEC.RING SA~ ~ T0 BE A LEN UPON SAID PR0~R~ IN AN AM0~T AS SHOE BY ~PORT 0F T~ CITY ~NAGER 0F DEL~Y BEACH, FLORIDA. ~REAS. the City Council of the City of Delra~ Beach, did, in ~!ar./~/~////~///session held on the 265%.9f July_and _ 23rd of Au~st, 1965 declare the existence of a nui- 'san%e' %~'o~ ~e~tain'l~ts-oP parcels of land, described in a list sub- mitted to them, for violation of the p~ovisions of Ordinance G-14?; ~~S, pursuit to such declaration, the City Clerk of said City did f~nish each of the respective owners of the lands described in said list with a notice desc~ibing the nat~e of the nuisance and that they must abate said nuisance within thimty (30) days, failing in which the City Council would have it done, ~d the cost thereof would be levied as an assessment against said p~ope~ty; and EELS, the o~e~s hereinafte~ n~ed did fail and neglect to abate the nuisance e~sting upon thet~ respective lands within the time p~esc~ibed in said notice and Ordinance G-~7, and the City of Del~ay Beach was Pequi~ed to and did ente~ upon the following lands and incu~ costs in abating the nuisance existing thereon as described in'the aforesaid list; and ~AS, the City M~ager of the City of Delray Beach, has, pur- suant to said O~dinance G-~7 and the City Cha~ter submitted to the City Council a ~eport of the costs incurred in abating the nuisance as aforesaid, said ~epo~t indicating the costs per parcel of land involved, NOW, TE~0~, BE IT ~SOL~D BY THE CI~ C0~CIL 0F T~ CI~ 0F DEL~Y B~CH, FLOR~A, AS FOLL0~: 1. That assessments in the individual amounts as shown by the ~epo~t of the City M~ager of the City of Delray Beach, involving the Cityfs cost of abating the af~esaid nuis~ces upon the lots or par- cels of land described in said ~epo~t, a copy of which is attached hereto and made a pa~t he.eof, a~e levied against the p~cels of land described on said ~epo~t and in the amounts indicated thereon. Said assessments so levied shall be a lien upon tho respectivo lots and parcels of land described In said ~epo~t, of the same nature and to the same extent as the lien for general city taxes and shall be collectible in the s~e ma~e~ and with the s~e penalties and unde~ the same pPovisions as to sale ~d foreclosume as city taxes a~e collectible. 2. That the City Clerk of said City shall, as soon as possible afte~ the effec{ive date, ~eco~d a certified copy of this ~esolution in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, and shall furnish to each of the owners n~ed in and upon said report a notice thst the Ci~ Council of the City of Delray Beach, did, on the ~ 26th o~ July an~ 2Srd o~ ~ugust~ 196~ order the abatement of a certain nuis~ce~ 'e'xi~ihg on thei~ des~ribed property and property o~er having failed to abate such nuisance, within the 30 day period, whereupon it was abated by the City at costs sho~ in said report and such assessments shall be legal, valid and binding obligations upon the property against which said assessments are levied. This resolution shall become effective 30 days from the date of adoption, and the assessments contained herein shall become due and payable thirty days after the mailing date of the notice of said assessment, afte~ which in~eres~t shall accrue at the rate of 6% per a~um on any unpaid portion PASSED A~ ADOPTED in ~!~~ _~ Se~s~'ion on the 8th _ day of ~.D.
