Res 1374-62 B. ESOLUTION NO. 1374. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELP~Y BEACH, FLORIDA, ORDERING THE 0PENI~G, GRADING AND PAVING OF THE NORTH-SOFFH ALLEY~LYING BETWEEN LOTS 19 THRU 27 AND LOTS 28 THRU 86, HALLER & GROOTMAN'..~ SUBDIVISION, TO A WIDTH OF SIXTEEN (16) FEET. WHEREAS, the City Council of the City of Delray Beach, Florida, did, on the~Sth day of January, 1962, adopt Resolution No. 1878 ordering the City Manager to prepare plans and specifications, together with estimate of cost of opening, grading and paving the North-South AlleyMlying between lots 19 thru 27 and lots 28 thru 86, Haller& Grootman's Subdivision to a width of sixteen (16) feet, and requiring said plans, specifications and estimate of cost of such improvement to be placed on file in the office of the City Manager, and WHEREAS, the City Council deems it to be necessary for the safety and convenience of the public to open, grade and pave said public right-of-way, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Delray Beach, Florida, that it is deter~dned to make the following described improvement, to-wit; To Open, Grade and Pave the North-South Alley~lying between lots 19 thru 27 and Lots 28 thru 86, Haller& Grootman's Sub- division to a width of Sixteen (16) feet, the total cost, as estimated, for such improvement being $2,000.00. BE IT FURTHER RESOLVED that the entire cost of such improvement shall be borne by ~he owners of lands abutting ~/~thereon, by Special Assessment SUBDIVISION LOT Haller& Groatman 19 & 20 It It ,~ 21, 22 & 25 " " 24 & 25 ~ " " West 70' of 26 & 27 " " 28 & 29 " " 30 " " 31 " " 32, 33 & 34 " " 35 " " 36 said benefits to be determined and prorated accordinE to the front footage of the respective properties as set forth immediately above. BE IT FURTHER RESOLVED that' said special assessments against all the parcels of ]ands as set forth above which are specially benefited, shall be and remain liens superior in disnity to all. other liens, except liehs for taxes, un.til paid, from the date of the assessment up.on the respectl.ve lots and parcels of ]and assessed, az~wh~ch shall bear znterest at the rate of e~ht(8) per cent per anaum, a.n~. which may be paid on three ($) equal yearly installments w~th accrued interest on all deferred payments. Payment shall be made at the same place that taxes payable to the City of Delray Beach, Florida, are paid, namely the office of the City Tax Collector, and upon failure of any property owner to pay the an.nual installment due, or any part thereof, or any annual ~nterest upon deferred payments, the City of Delray Beach may bring necessary legal proceedings by a Bill in Chancery to enforce ayment thor.eof with all accrued interest, together with all egal costs lncurred,~inc.luding a reas.ona.ble attorney's f.ee. The total amount of ahy l~en may be paid ~n full at any time with interest from the date of assessmsnt. IT IS ORDERED that the City Council shall sit at the City Hall in the City of Delray Beach, Florida, at 8:00 P.
