Res 1410-62 839 No. 14 o A RESOL~ION 0F T~ CITY CO~CIL OF T~ CITY OF DEL~Y BEACH, FLORIDA~ ASSESSING COSTS FOR ~BATING ~ISANCES UPON CERTAIN ~.I~S LOCATED ~tIN SAID CITY: SETTING O~ ACTUAL COSTS INCL~RED BY SAID CITY T0 ACCO~LzoH SUCH ~TE~T~ A~ LEVYING ~'~ ~" '~'~.~ COST 0F SUCH OF SAID NUISANCES, AND DEC~RiHG SAID LE~ T0 BE A LIEN UPON SA ED PROPERTY I]'¥ AN AM0~T AS SHO~ BY ~PORT OF T~ CITY ~NAGER 0F DEL~Y BEACH, FLORIDA ~REAS, .t~e City Council of the City of Del~ay Beach, did, tn -- end/o~, regular session held on the ll~ ~_..~a~ 9~J~$_ _, 1962 declare the existence of a nui- ~-a~C~~~~~~~~f land, described in a list sub- mitted to them, for violation of the provisions of Ordinance ~P~S, pursuant to such declaration, the City Clerk of said City did furnish each of the respective ownems of the lands described in said list with a notice describing the nature of the nuisance and that they ~ust aba~e said nuisance within thirty (30) days, failing in which the City Council would have it done, ~d the cost thereof would be levied as an assessment against said property; and ~EREAS~ the o~ers hereinafter named d~.d fail and neglect to abate the nuisenc~ e~sbing upon their respective lands within the ti~e prescribed in said notice and Ordiu~nce G~.~7, and the City of Delray Beach was requi~ed to and did enter upon the following lands and incur costs in abating the nuisance existing thereon as described in'the aforesaid list; ~d ~AS, the City M~ager of the City of Delray Beach, has, pur- suant to said Ordinance G-~7 and the City Charter submitted to the City Council a report of the costs incurred in abating the nuisance as aforesaid, said report indicating the costs per parcel of land involved, NOW, T~R~m0~, BE IT ~SOLVED BY THE CITY C0~CIL 0F T~ CI~ OF DEL~Y B~CH, P~R~A, AS FOLLOWS: 1. That assessments in the individual amounts as sho~ by the report of the City Mane. get of the Cit~ of Delray Beach, involving the City.s cost of aba~.~.no the afc~.esa~d nuisances upon the lots or par- cels of laud described in said report, a copy of which is attached hereto and made a par'b hereof, are levied against the parcels of land described on said repo~t and in the amounts indicated thereon. Said assessments so levied sh~!l be a lien upon tho respective · lots and parcels of land described in said report, of the same nature and to the s~e extent ~s the lien for general city taxes and shall be collectible in the s~e manner and with the s~e penalties and under the same provisions as to sale and foreclosure as city taxes are collectible. 2. That the City Clerk of said City shall, as soon as possible after the effective date, reco~d a certified copy of this resolution in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, and shall fu~ish to each of the owners n~ed in and upon said report a notice that the Ci~ Council of the City of Delray Beach, did, on the llth dam cE June~ 1962 Order the abatement-of a~ert~in"nUisance- ex~st-fng on'their dbsc~ig~d property ~d property o~er having failed to abate such nuisance, within the 30 day peyiod, whez, eupon it was abated by the City at costs sho~ in said report and such assessments shall be legal, valid and binding obligations upon the property against which said assessments are levied.
