M., with Mayor Hike Yar~ates in the Chair, City Manager W. ~:. Lawson Jr., City ~tttorney John H. Adams and the following com- mission Members being present; Catherine E. Strong, W. J. Snow, Emory J. A ItkSOLUT10N OF THE CITY C0MHISSION Ok D~.LILAY BEACh, ILO~[1DA, APPROVING A SPEC- IAL ACT TO BE SUBHITTEO TO TIlE LEGISLA- TUHE U~ TH~ STATE Ol~ t'LO~Ii~A FOit ENACT- MLNTo ~tEaEA~, the City Council of the City of Delray Beach, Florida, determines that it is to the best interest of the general public of the City of Delray Beach, ¥1ori~a, in order to preserve the health, safety and general welfare of the com- munity to cause to be passed special legislation re-defining the municipal boundaries of the City of Delray Beach, Florida, *UNb WHEfib:AS, it is of the utmost importance that such a legislative act be passed with all possible speed, ~R~,tbF0~(k, BE IT i0oSOLVED, by the City Council of the City of l)elray Beach, Florida, as follows: Section 1: That the City Attorney, John H. Adams and special Councel, Oohn Moore, are authorized and directed to draft a special act of the legislature re-defining the bound- aries of the City of Delray Beach, Florida, by excluding the entire negro araa therefrom, and to take all necessary and re- quired steps incident to having the same enacted into law as soon as possible. D., 1956. ~ R. D. Worthing. Conm~issioner Snow moved that ~esolution No. 1008 be adopted asread. The motion was seconded by Commissioner Cromer and Call Of i(oll, Mayor Yargates and Commissioners Snow, Cromer and ~arrow favored the motion, voting yes, Commissioner Catherine E. Strong was opposed. Ho%ion carried. Commissioner Strong stated that prior to voting in op:osition 100 JONE 5TH, 1956 to the motion for adoption of aesolution No. 1005, she did not £eel that this metiiod would solve the problem of current issue and that, further, she did not believe there had been sufficient time devoted for consideration of the proper solution concernin-_' the issue involved, and, therefore, had voted "NO". Attorney John Moore, authorized by i(esolution No. 1008 to represent the City of Delray Beach, as special counsel, an aid to City Attorney John H. Adams, informed those present that such an act, by virtue of legality, would contain provision for a referendum and the people, at such time, could accept or reject the proposal by majority vote thereon.
