07-09-56 125 JULY 9TH· 1956 A ~egular Meeting of the City Commission was held in the Commission Chambers at 7:30 P. M., with Mayor Mike Yargates in the Chair, City Manager W. E. Lawson· Jr., City Attorney John H. Adams and the following Commissioners being present; Catherine E. Strong, W. J. Snow, Emory J. Barrow and Howard Lee Cromer, a full Commission being present. An opening prayer was delivered by Rev. J. T. Hayes. · CommissiOner Cromer moved for approval of the Minutes for the June 25th and July 2nd meetings as amended. Motion was seconded by Commissioner Barrow and unanimously carried. City Manager W. E. Lawsom, Jr., then informed the Com- mission the results of study and survey by Smith & Glllespie concerning water and sanitary sewer needs for Delray Beach, and recommended immediate action toward providing an additional well as sonn as possible to meet the need for supplying water requirements. Commissioner Cromer moved for approval of the City Manager's recommendation and authorized the Manager to turn this matter over to Smith & Gillespie for preparation of plans aris speci- fications, and to request Bids, at the earliest possible time, as it is imperative that the water supply be augmented before the Coming season's peak requirements. Motion was seconded by Commissioner Barrow and unanimously carried. The City Manager then advised the Commission of progress. made with re~ard to obtaining Deeds to the City for the now privately owned Sidewalk and curb on the East side of S.E. 4th Avenue and immediately south of the Library for which the pres- ent owners seek compemsation for original costs of Sidewalk and Curb construction. Commissioner Barrow moved that the City Manager be instructed to obtain Dedication of the privately owned Sidewalk and Curb on the East side of S. E. 4th avenue between Atlantic Avenue and First Street. Motion was seconded by Commissioner Strong and unanimous ly carried. City Manager Lawson then read a letter from the Lake Worth Drainage District ~erein they requested that all subdivision plats, subject to approval by the City Commission, which, in any way, affect any facility or right-of-way of the Drainage District, be submitted to that Board for approval or disaproval prior to any final action by the Commission, in order to avoid any pos- sible violation of the Statutes of the State of Florida concer$- lng such subdivision approvals. Commissioner Cromer moved that the City Manager and City Attorney investigate this matter, reporting back to the Com- mission at the next meeting relative to the boundaries of the Drainage District and their authority, also the State of Florida Statutes concerning same. Motion was seconded by Commissioner Strong and unanimously carried. City Cl'erk There being no objections at the public hearing, scheduled for today, concerning the proposed improvement, Commissioner Snow moved that Resolution No. 1016 be passed and adopted on its first and final reading. Motion was seconded by Commissioner Barrow and unanimously carried. The Commission instructed the City Manager to provide, in, contract awards, for completion date and penalty fee of ~50.00 per day for delay in completion. Commissioner Barrow then moved that the City. Manager should advertise immediately for Bids covering Andrews Avenue im- provements, Motion was seconded by Con~nissioner Snow and unani- mously carried. City Manager W. E. Lawson jr., then read the report of the Planning Board: Item 1. HE ~lo Del trey Shores - The Planning Board recommended provision for additional R/W width on Federal High- way, also that area drainage be approved by the City Engineer, that sewage disposal be in accord- ance with board of Health requirement, that the developers give satisfactory assurance to the City that they will build and finish-pave all streets JULY 9T~, 1956 shown, that the final plat be returned to the Planning Board for approval, that prints of the approval plat be flled with the City showing - water supply lines and fire hydrants power poles and street lights, if any invert elevations of storm and/or sanitary sewers, if any Commissioner Barrow moved for adoption of the recommendation of the Planning ~oard and that the Plat be returned to the developers for compliance therewith. Motion was seconded by Commissioner Strong and unanimously carried. Item 2. Hequest of Delray Split ~ock - Commissioner Strong moved, in accepting the recom- mendation of the Planning Board, to grant the request of Delray Split Aock Co., for expansion of their present plant, said improvement to be completed not later than January 1st, 1957. Motion was seconded by~,Commissioner Cromer and unanimously carried. Item 3. Hequest of Mrs. Sybil Buckingham - Commissioner Snow moved that this deviation request for alteration of a garage be again referred to the Planning/Zoning Board for further consideration. Motion was seconded by Commissioner Barrow and unanimously carried. Commissioner Strong moved that Bills, in the sum of. , ~102,107.42, be paid subject to the approval of the Finance Committee. ~totion was seconded by Commissioner Cromer and unanimously carried. Co~ntssioner Cromer moved that the City of Del ray ~each pay the Bill from the Miami attorneys for expenses incurred in the - Youngblood, et al vs. the City, amounting to ~1,082.66. ~otion was seconded by Commissioner Barrow and unanimously carried. Commissioner Strong opened for discussion that a policy should be established concerning requests for moving of houses from one location to another, it being suggested that property owners in the area where a house was contemplated being located be contacted and given an opportunity to object if they so desired. Further, that any building moved should otherwise conform with City Building and Zoning regulations. Commissioner Cromer moved that the request to move a frame house from Lot 7, Block 100, to Lot 15, Lincoln Park, be referred to the ~uilding Inspector and that he contact property owners within the Block area affedted for objections, if any, to such location of said house, reporting back to the Commission at the next regular meeting. Motion was seconded by Commis- sioner Snow and unanimously Barried. Commissioner Barrow moved that the following requests be referred to the Planning/ Zoning Board for their study and recommendation: 1. Owner of Lot 85 Plumosa Park Sideyard Deviation. 2. Owner of Lot 8 Carver Square Permit to build Duplex. 3. Owner of Lots I~ & 6, Blk. 4, Dell Park, Duplex on each Lot. 4. Owner of Lot 19, Blk 5, Dell Park Desires to build Duplex. ~otion was seconded by Commissioner Snow and unanimously carried. The City Manager then read a letter from County Com- missioner Ben Sundy wherein the Commissioner advised tha~ Boynton Beach has requested the County Commission not to dispose of the County owned lands in the Lake Ida area, pre- vioulsy requested by Boynton Beach, Delray Beach and Gulf- JULY 9Th, 1956 stream, and further, not to permit construction of an air strip. Commissioner Strong suggested that the City of Delray Beach should request transfer, to the City, o£ County owned parcels of land adjoining the general Del ray area and which do not lie in any other municipality. Mayor Yargates agreed to contact the County Commission concerning such transfer. The City Manager then read a request from Tropic Isle, Inc. and recommended ;hat the City provide for 365 feet of the water lines necessary in serving Tropic Isle S/D. Commissioner Barrow moved for approval of the City Manager's recommendation that the City of Delray Beach pro- vide the necessary 365 feet of water line installation. Motion was seconded by Commissioner Strong and unanimously carried. Commissioner Cromer moved for payment, by the City, of the charge for Bus Service on the 4th of July in transporting children to Jupiter Beach, amounting to $148.40. Motion was seconded by Commissioner Snow and unanimously carried. Concerning City Hall air-conditioning, the Commission instructed the City Manager to obtain costs for City Hall main floor installation, as well as the Commission Chambers. Mr. Milner, of ~osella's Bakery, requested relief from congested parking in front of the bakery, which apparently, has resulted from recent elimination of meter charge. Commissioner Strong moved that effective July 15th, 1956 parking meter charge be re-established on all streets where meters are installed, and that Fli~ PA~[KING be made available ONLY on the City Parking Lots, South of the City Hall and be- tween N. E. 3rd and 4th Avenues l~nediatly South of Ist Street until October 1st. Motion was seconded by Commissioner Snow.
